Scope of the Right of Withdrawal

This right of withdrawal applies exclusively to consumers within the meaning of § 13 BGB (German Civil Code).

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

For entrepreneurs (§ 14 BGB): There is no right of withdrawal. An entrepreneur within the meaning of § 14 BGB is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade or independent professional activity. If you order flowgeist products in the context of your entrepreneurial activity, you do not have a right of withdrawal.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (flowgeist – Ralf Carsjens, Eidamshauser Straße 13, 40822 Mettmann, Germany, email: info@flowgeist.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form, but it is not obligatory.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Special Notes

Digital Content

For contracts regarding the supply of digital content not on a tangible medium (e.g. software, cloud services, SaaS subscriptions), your right of withdrawal will expire once we have begun the performance of the contract, and only after:

1. you have given your express consent to our beginning the performance of the contract before the end of the withdrawal period, and
2. you have confirmed your knowledge that you lose your right of withdrawal once the contract is performed early.

This consent is obtained during the order or registration process.

Trial Period

Using a free trial phase does not constitute consent to the start of the contract. The right of withdrawal remains fully in effect during the trial phase. Only upon completion of the trial phase and commencement of the paid term is early fulfilment considered agreed.
